MONDAY, 6 th MAY 2024 P.C :

By this petition, the petitioner seeks the following substantive relief :

"(B) That this Hon'ble Court may direct the Respondent No.1, by Order of Writ of Mandamus or any other appropriate writ or order to lodge the FIR against the accused persons as per complaint dated 18/11/2019 with Economic Offence Wing, Mumbai."

Mr. Konde Deshmukh, learned Addl. PP, on instructions, states that the petitioner's complaint was looked into by the EOW, Mumbai and after conducting a preliminary inquiry, SQ Pathan 1/2

21-WP-1456-2020.doc EOW, Unit-9, Mumbai came to the conclusion that the dispute is of a civil nature and accordingly filed the petitioner's complaint. Mr. Konde Deshmukh, learned Addl. PP submits that the said decision has been communicated to the petitioner vide letter dated 10th February 2020.

Considering the aforesaid, nothing survives for further consideration in the petition. Petition is accordingly disposed of.

Needless to state that the petitioner is at liberty to take appropriate steps in accordance with law before the appropriate forum/Court.

We make it clear that we have not gone into the merits of the petitioner's complaint and as such, all contentions of all parties are kept open.
