Mr. Kaka states that the agreement, based on which petitioner approached the AAR, has not been acted upon and no payment has been made and, therefore, seeks leave to withdraw the petition with liberty to agitate the issues involved in another appropriate matter. Mr. Kaka further states that since the agreement has not been acted upon, they are withdrawing the petition but do not accept the opinion expressed by the AAR.
