As the regular Bench presided over by the Hon'ble Justice Shri N.H.Patil has declined to take up this Petition, as per the general standing order of the Hon'ble the Chief Justice, the present Petition will have to be heard by this Bench.

Copy of the final report dated 6 February 2016 submitted by the Police before the learned Magistrate is placed on record. It shows that notice has been issued by the learned Magistrate on the

upk wp-877-16 said report to the Petitioner, who is original complainant. Learned APP states that the notice has been already served to the present Petitioner. Therefore, it is for the Petitioner to take appropriate steps and to file a protest Petition.

In view of filing of the final report, the prayer for transfer of investigation and taking departmental action against the erring officers cannot be entertained at this stage.

By keeping open all contentions of the Petitioner and the remedies of the Petitioner expressly open, the Petition is disposed of.
