The above Writ Petition has been filed seeking a direction to the State-CID to file the investigation report. The second relief sought is for a direction to the Sessions Judge, Pune for trials to be held on day to day basis in Special Sessions Case No.239 of 2016 and the Sessions Case No.512 of 2016. The last relief sought is for a direction that the said Special Sessions Case No.239 of 2016 and Sessions Case No.512 of 2016 be disposed of within three months from the date of the final order passed by this Court. The learned APP Mrs. P P Shinde appearing for the Respondent/State has tendered the report of Shri Rajendra B Dahale, the Superintendent of Police and holding additional charge of the State-CID, Crime Branch, Pune as also the report of Dr. Vaishali Kadukar, the Additional
Superintendent of Police, State-CID, Crime Branch, Pune. In so far as the report of Shri Rajendra Dahale is concerned, the same is in respect of C.R. No.79 of 2016 and in so far as the report of Dr. Vaishali Kadukar is concerned, the same is in respect of C.R. No.46 of 2016. The learned APP has also tendered another report of Shri D G Navkudkar, the Additional Superintendent of Police, State-CID, Crime Branch, Pune. The said reports are in respect of further investigation carried out under Section 173(8) of the Criminal Procedure Code in respect of the allegations which have been made against the police officers.
We have perused the said reports submitted by the police officers. The sum and substance of the said reports is that nothing incriminating has been found against the police officers against whom the allegations have been made. The reports therefore conclude by stating that the allegations made against the police officers are unfounded.
The learned APP Mrs. P P Shinde appearing for the Respondent/State states that the reports have already been submitted to the Trial Court on 07/08/2018 and 08/08/2018 respectively. Hence in so far as prayer clause (a) is concerned, in the light of the said reports the relief sought vide the said prayer has been worked out.
Having regard to the nature of the case in question, we deem it appropriate to expedite the trial in Special Sessions Case No.239 of 2016 and Sessions Case No.512 of 2016 and having regard to the fact that the trial had already commenced prior to the Division Bench of this Court passing the order dated 07/06/2017, we direct the concerned Sessions Court to hear and decide the said cases expeditiously and within the outer limit of 28/02/2019. With the directions as aforesaid, the above Writ Petition is disposed of.
