This Interim Application is filed for restoration of the Writ Petition, which was dismissed for non-removal of the office objections. There is delay in filing the Writ Petition. 2.

Heard. I have gone through the contents of the Interim Application. Case is made out to allow this Interim Application. The Interim Application is allowed in terms of prayer clauses (a), (b) and (c).

The Interim Application is accordingly disposed of. WITH WRIT PETITION NO.1455 OF 2004 1.

Mr.Surel Shah, advocate appears for the Applicant on instructions of one Mr.Gurunath K. Manchanpalli, who identifies himself as the son of the original Petitioner, informs this Court that the Petitioner is the original tenant, who are ready to vacate the suit premises, subject to reasonable time to vacate the same is given.

Mr.Alange submits that he will have to take instructions from his client. Mr.Shah on instructions from the son of the Petitioner, who is present in Court submits that the Petitioner's son is ready to vacate the suit premises and hand over possession within six months from today to the Respondents.

Suffice will be the purpose if the Petitioner and his family members give the usual undertaking to this Court within a period of one week from today. The Petitioner is granted time of six months to vacate the suit premises subject to filing of usual undertaking to vacate by the Petitioner and his adult family members within one week. A copy of such undertaking should be furnished to the Respondents within one week from today. 4.

The Writ Petition is accordingly disposed of, as not pressed.
