1) Heard learned counsel for the applicant and learned APP. Police officer from the concerned police station is present. Applicant herein is seeking relaxation of conditions and permission to travel abroad during the period 02/04/2015 to 20/05/2015.
2) By an order dated 08/10/2014, this Court (Coram: Mrs. Mridula Bhatkar, J.) had allowed the application seeking same prayers. Applicant was directed to hand over the passport to the Sessions Court after returning from the foreign countries. Learned counsel for the applicant, upon instructions
2 52.211.15 appp submits that he has not committed breach of any conditions passed vide order dated 08/10/2014. Hence, he seeks the same prayer. Applicant has furnished his itinerary for the period 02/04/2015 to 20/05/2015. It is submitted that applicant herein is proprietor of an advertisement agency and that it is necessary for him to travel to foreign countries for his projects. 3) Learned APP submits that investigation is completed and charge-sheet is filed. Moreover, investigating agency has reposed faith in the applicant and has given no objection for travelling abroad. 4) Taking into consideration the fact that applicant was granted permission on the previous occasion, applicant would be entitled to the same relief.
O R D E R
(i) Application is allowed in terms of prayer clause 'b'. (ii) Learned Sessions Court shall return the passport to the applicant for a limited period for his trips from 01/04/2015 to 20/05/2015. (iii) Applicant, upon returning on 20/05/2015, shall entrust the passport with the Sessions Court by 25/05/2015.
3 52.211.15 appp (iv) Applicant has furnished his itinerary in the present application, however, he shall submit the same before the Sessions Court as well as concerned police station before he travels abroad. He shall give his cellphone no. and address and other details to the concerned police station as well as to the Sessions Court. (v) Applicant is at liberty to file further application seeking permanent modification of the order after he returns on 20/05/2015. (vi) Application is allowed and disposed of.
