1. Heard the learned Advocates appearing for the parties and the parties who are present in Court and the following order is passed by consent : i. Both parties have agreed to apply for and obtain divorce by mutual consent. ii. Parties shall file the Petition seeking dissolution of their marriage by mutual consent before the Civil Judge, Senior Division, Panvel on or before 28th October, 2017.

iii. The Respondent undertakes to pay an amount of Rs. 3,50,000/- by NEFT / DD to the Applicant in full and final settlement of all her claims against him. The said amount of Rs.3,50,000/- shall be paid as follows : a. Rs.1 Lac on or before 13 th September, 2017.

Nitin 2 / 2 911-MCA-118-2017.sxw b. Rs.50,000/- on or before 15 th October, 2017.

c. Rs.1 Lac on or before 20th November, 2017. d. Rs.1 Lac on the date of divorce granted by mutual consent to the parties. iv. Save and except what is agreed / directed herein, the parties have no claims of whatsoever nature against each other.

v. Application No. 20 of 2017 filed by the Applicant under the Protection of Women from Domestic Violence Act, 2005 against the Respondent before the JMFC, Kolhapur shall be adjourned from time to time till the parties obtain divorce by mutual consent. The said Application shall be unconditionally withdrawn within a period of two weeks from the date of the Civil Judge, Senior Division, Panvel granting divorce to the parties by mutual consent.

vi. The above Misc. Civil Application is accordingly disposed off. vii.Parties unconditionally withdraw the allegations made against each other. viii.Though the above Misc. Civil Application is disposed off, liberty is granted to the parties to apply in case of any difficulty.
