DATE : 7th AUGUST, 2023 P.C:- When the matter is called out, Mr. Khandeparkar, learned counsel for the petitioner submits that the order pursuant to which the execution was allowed was challenged before the Appellate Bench and this challenge has been dismissed by the Appellate Bench of the Small Causes Court on 6th May, 2023 against which Civil Revision Application being (Stamp) No. 15754 of 2023 has already been filed in this Court and therefore nothing survives in this petition. He therefore submits that this petition be disposed as infructuous. 2.
