Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail by the applicant in connection with First Information Report (FIR) No.37 of 2023 dated 14/01/2023, registered with Park Site Police Station, under sections 326, 504 and 506 of the Indian Penal Code, 1860.

The date of the incident is 13/01/2023. It is alleged that the applicant assaulted the complainant with punches. As a result of a finger ring, the complainant sustained injuries on his face and head. The injuries are simple in nature. Later on, an offence under section 324 has been registered.

Learned APP, on instructions of the Investigating Officer, submits that the custody of the applicant is not required, and according to me rightly so. Hence, the following order.

ORDER

(a) In the event of arrest in connection with FIR No.37 of 2023, registered with Park Site Police Station, the applicant- Zubair Gulam Hussain Shaikh, shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount;

(b) The applicant shall report to the Investigating Officer on 08/03/2023 and 09/03/2023 between 11.00 am and 01.00 pm and thereafter, as and when called;

(c) The applicant to co-operate with the Investigating Officer;

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

The application stands disposed of.
