This is an application for restoration of Criminal Appeal bearing No.251 of 2017 which was dismissed for want of prosecution vide order dated 16th January 2019. It is not necessary to issue notice to respondent No.1 as the appeal was dismissed in default due to the appellant not taking steps for effecting service on respondent No.1.

Heard the learned counsel appearing for the applicant/accused as well as the learned Additional Public Prosecutor appearing for the Respondent/State. 3.

For the reasons stated in the application, the following order:

ORDER

(i) The order dated 16th January 2019 dismissing the Criminal Appeal bearing No.251 of 2017 is recalled and the said Criminal Appeal is restored to the file. (ii) The instant application is accordingly disposed of. (A.M.BADAR J.) Aarti Palkar 2/2
