1] On 20.03.2020, this Court passed the following order : "Learned counsel for applicant submits that the dispute has been settled. It is submitted that the application of the applicant was rejected by this Court, however, the parties have now settled the dispute and preferred this application. Learned counsel for respondent-complainant submits that the complainant has no objection for granting relief in this application. The affidavit of settlement has been annexed to the application. To enable the complainant to remain present in Court, stand over to 21st April 2020. To be listed on supplementary board. Till then the applicant shall not be arrested."

2] When the matter is listed after expiry of two years and the Investigating Officer is confronted with the Affidavit filed by the complainant at Exhibit D, he state that custodial interrogation of the Applicants is not necessary.

(13)ABA-665-2020.doc 3] Accepting the aforesaid statement, following order is passed :

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.346/2018 registered with Juhu Police Station, the applicants Prakash Jibhai Barot and Umesh Parshuram Rao shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each with one or two sureties of the like amount.

(c) The applicants shall report to the concerned police station as and when called for.

(d) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
