Learned APP on instructions from Superintendent, Nashik Road Central Prison, Nashik submitted that, subsequent to the rejection of Petitioner's Application dated 5th July, 2019 for furlough leave, the Petitioner was released on Covid-19 pandemic emergency parole leave from 23rd June, 2021 to 2nd June, 2022. That, the Petitioner reported back to Jail Authority within stipulated period.

In view thereof, the grievance of the Petitioner in the present Petition does not survive and the Petition is accordingly disposed off. 3.
However, we make it clear that, Petitioner will be entitled to file a fresh Application for furlough leave as may be permissible under the Prisons (Bombay Furlough and Parole) Rules, 1959. (PRAKASH D. NAIK, J.) (A.S. GADKARI, J.) 1/1
