This is an Application under Section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R.No.92/2022 registered with Goregaon Police Station, Mumbai for offences punishable under secitons 341, 354-D, 509, 506 (2) of the Indian Penal Code.

Heard Mr. Tanveer Farooqui, learned counsel for the Applicant and Ms. Rutuja Ambekar, learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The first information report prima facie indicates that the first informant is known to the Applicant since last eight years and they had friendly relations with each other. It appears that the Applicant subsequently got friendly with another girl. The relationship between the Applicant and the first informant got strained on the said issue. The complainant has alleged that when she had questioned the Applicant about his love relationship with the other woman, the Applicant had abused her in filthy words.

Considering the nature of the accusations and allegations, in my considered view, this is not a case which would justify custodial interrogation. The Applicant is a resident of Mumbai. There is no possibility of the Applicant absconding or thwarting the course of justice. Under the circumstances, the Anticipatory Bail Application is allowed on following terms and conditions :- (a) In the event of arrest of the Applicant in C.R.No.92/2022 registered with Goregaon Police Station, Mumbai, he shall be released on bail on furnishing bail bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand only) with one or two sureties in the like amount ; 2/3

(b) The Applicant shall report to the Investigating Officer for two days from 21/03/2022 between 11:00 a.m. to 02:00 p.m. and/or as and when required by the Investigating Officer. (c) The Applicant shall not interfere with the first informant and/or other witnesses in any manner. (d) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact numbers, and/or change of residence or mobile details, if any, from time to time.

The Application stands disposed of.
