It is an admitted position that the Award was passed as back on 7 February 2007. In the circumstances, the trial Court has rightly observed that since the Award is not challenged under Section 34 of the Arbitration Conciliation Act, 1996, the executing Court cannot sit in Appeal over Award.

No fault can be found in the impugned order. The Arbitration Appeal shall accordingly stand dismissed in limine. No costs. ( A.A. SAYED, J.) Sameer 1 of 1
