Heard learned counsel appearing for the respective parties.

The Writ Petition is filed invoking jurisdiction of this Court under Article 226 of the Constitution of India for transfer of investigation. C.R. No.0062 of 2016 is registered for offences punishable under Sections 304A, 337, 279 of Indian Penal Code and Section 184 and 134 of the Motor Vehicles Act with MIDC Police Station, Taluka-Mahad, District-Raigad.

The learned APP placed on record the report of Assistant Police Inspector, Mahad MIDC Police Station dated 24.08.2018. The report states that investigation in subject FIR is already over and A-Summary report is submitted before the Judicial Magistrate First Class, Mahad on 18.06.2018.

In the light of the above factual position, we are not inclined to entertain this petition. The petitioner is however at liberty to contest the Summary report stated as above. The Writ Petition is disposed of.
