Heard learned Counsel for the parties.

Vide order dated 2nd February, 2017 passed in Criminal Bail Application No. 284 of 2017, the applicant was granted temporary bail for a period of 4 weeks, in view of the undertaking given by him. Vide the said order, the applicant was directed to deposit, by pay order/demand draft a sum of Rs. 25 lakhs in the Consumer Court on or before 6th February, 2017 1/3

and the balance amount by 28th February, 2017. It was made clear in the said order, that the balance amount would include 18% interest also. 3.

Learned Counsel for the applicant states that the applicant is presently in custody in some other case. He submits that the applicant was unable to deposit entire amount so directed. It appears, that the applicant has not deposited the 18% interest, pursuant to the undertaking given by him in this application.

Since the applicant has not complied with the order dated 2nd February, 2017 and the subsequent orders, the application is dismissed for non-compliance of the same. The applicant is already in custody in some other case. The applicant is, however, granted liberty to file a fresh application when and if the applicant complies with the order dated 2nd February, 2017.

Criminal Bail Application No. 284 of 2017 is disposed of accordingly.

In view of the above order, nothing survives for consideration in the application for extension of time to make part payment being Criminal Application No. 181 of 2017. The same stands disposed of accordingly.
