Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to fle a revision petition before the Sessions Court against the order dated 6.11.2017 passed by the Metropolitan Magistrate, 43rd Court, Borivali, Mumbai in C.C.No. 4302726/SS/2017.

Writ Petition is dismissed as withdrawn with liberty as sought for.

If delay application is fled alongwith the revision petition, then the Revisional Court shall decide it on it's own merits, however, shall take into consideration the fact that the present petition was fled, which caused the delay in fling the revision petition.
