Heard the learned counsel for the Applicant and the Respondent No.1 Nitin Shah party in-person.
The learned counsel for the Applicant seeks permission to withdraw the present Civil Application with liberty to file a fresh for same cause of action. To that effect, he has given in writing. Same is taken on record and marked "X" for identification. Aswale 1/2
12.99.18-cao .doc Respondent No.1-Nitin Shah submits that he is appearing party in-person and therefore he may be provided costs. Considering these facts, following order is passed:- a) Civil Application stands disposed of as withdrawn with liberty to file a fresh for same cause of action.
b) The Applicant to pay costs of Rs.3,000/- to Mr. Nitin Shah before filing fresh application.
