This Appeal is preferred by the New India Assurance Company Limited against the judgment and award dated 8th October, 2015 passed by the Additional Member, Motor Accidents Claim Tribunal,

2/3 FA-990-2016 (SR.38) Pune in M.A.C.P. No. 601 of 2013. The claim is settled between the parties and they have arrived at consent terms dated 8th December, 2018. The consent terms are taken on record and marked 'X' for identification.

The parties are present before the Court. The terms of the consent terms are explained to them. They admit the same. The parties are identified by their identity proof i.e. Aadhar Card. Copy of the same is taken on record.

The appeal is disposed of in terms of the consent terms.

In view of disposal of the First Appeal, Civil Application No. 2581 of 2016 does not survive. The same is disposed of as having become infructuous. 5.

Office is directed to refund the amount of Rs.25,000/- to the appellant. Refund of court-fees as per Rules.
