Learned APP submits on instructions that the FIR has been registered for offences under Section 504, 506 & 509 of Indian Penal Code. No offence in the nature of non bailable would be registered in the present FIR. The applicant has preferred application before the Sessions Court which is due for hearing on 23th March, 2020. The said application was adjourned to 23rd March, 2020 without protection. The FIR is registered for offences which are bailable. However, the applicant apprehended that non bailable offence would be added to case. In view of statement made by the learned APP on instructions from the officer who is present in the Court, the question of entertaining this application does not arise as the FIR was

Sajakali Jamadar 906-ABA-675-2020.doc registered for bailable offences. Learned counsel for the applicant submits that in view of the statement of learned APP he would withdraw this application and the application pending before Sessions Court, Mumbai.

Hence, application is allowed to be withdrawn and stands disposed off accordingly.
