Mr Raje, learned counsel for the appellant places on record a letter dated 28.10.2013 addressed by him to the appellant, requiring him to furnish further instructions in the matter. Mr Raje points out that the notice has been returned with remark that the 'appellant has left'. Mr Raje submits that he has made his best efforts to contact the appellant, however, such efforts have borne no fruits. In these circumstances, he is constrained to report "No Instructions".

The appeal is of the year 1996. Till date, despite liberty, no private paper book has been filed. Ultimately, the decree holder, is stated to have filed the private paper book.

Now that, Mr Raje reports "No Instructions", the appeal is Pg 1 of 2

19.fa.642.1996.doc dismissed for non-prosecution. Interim order, if any, stands vacated. Mr Raje requests that the xerox copy of letter dated 28.8.2010 along with envelope by which service was admitted, are kept on record.
