Heard learned counsel for the parties for some time. 2.

Learned counsel for first Respondent states that Petitioner has an alternate remedy against the impugned order of approaching the Consumer Grievance Redressal Forum (for short "CGRF") inasmuch as the impugned order is passed by the Consumer Grievance Redressal Cell (for short "CGRC").

Learned counsel for the Petitioner states that Petitioner shall approach CGRF after seeking condonation of delay if permissible on account of pendency of this petition.

In the circumstances, writ petition is disposed of. Petitioner 1 / 2

16 - WP. 7226-16 shall be entitled to approach CGRC, if otherwise permissible, within a period of three weeks. If such an appeal is filed, the CGRC shall take into account the fact that from 1.4.2016 till today i.e. 14.1.2020 present petition is pending before this Court, and shall decide the appeal on its own merits and in accordance with law. Rival contentions of the parties are left open. In the circumstances, there shall be no order as to costs. .

Writ petition is disposed of in the aforesaid terms, Sd/- C. V. BHADANG, J.
