Learned counsel for the Respondents states that parties have amicably resolved their dispute and have filed Consent Terms in this Court, on 04.10.2016, in (Cri.) W.P.No.1942 of 2016. Learned counsel for the Respondent No.2 relies on Clause (II) of the Consent Terms which reads thus :- "(II) It is hereby agreed and undertaken between the petitioner (Husband) and Respondent (wife) that both the
CP 100-16.doc parties will mutually withdraw all the allegations levelled against each other and also undertake to withdraw all the pending criminal and civil proceedings initiated against each other within seven days of filing affidavit evidence before Ld. Family Court, Mumbai."

The Petitioner was absent even on the last date. Even today none appears for the Petitioner.

Accordingly, the Petition is dismissed for want of prosecution.
