This is an application for suspension of sentence imposed upon the applicant by the learned Trial Court and upheld by the Appellate Court.

2) The applicant has been convicted by the learned Trial Court for an offence punishable under Section-324 of the Indian Penal Code and sentenced him to suffer simple imprisonment for 2years and to pay a fine of Rs.10,000/- and in default to payment of fine to further under go simple imprisonment for 30 days. The appeal Court has turned down the appeal preferred by the applicant. 3) As the maximum sentence imposed upon the applicant is of 2 years, the substantive sentence imposed upon the applicant is hereby suspended.

2 /2 4) The applicant be released on bail in CC No.21/P/2000 on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount before the Trial Court. 5) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
