Mr. Marathe, learned counsel appearing for the Applicant states that, the order dated 24th November, 2022 is passed in the Second Appeal by the learned Registrar (Judicial-II), by which, the Second Appeal was directed to be dismissed against Respondent No.2A if, no steps are taken within a period of two weeks to serve unserved Respondent No.2A.

Mr. Marathe, learned counsel states that, in fact, Respondent No.2A was served and, accordingly, affidavit of service was already filed on 4th August, 2017. 3.

Therefore, for the reasons set out in the Interim Application, the same is allowed in terms of prayer clauses (a), (b) and (c).
