The petitioner has impugned the order passed by the Deputy Registrar, Co-operative Societies, Pune City-5, Pune, respondent no.2 herein which was passed under section 101 of the Maharashtra Cooperative Societies Act, 1960. The petitioner has not filed any revision application under section 124 of the Maharashtra Co-operative Societies Act, 1960 which is the alternate remedy available with the petitioner against the said order dated 19th December,2013. I am thus not inclined to entertain this petition impugning the order dated 19th December,2013.

At this stage, Mr.Page, learned counsel for the petitioner seeks liberty to withdraw this petition with liberty to file revision application under section 154 of the Maharashtra Co-operative Societies act, 1960. 3.

Writ petition is dismissed as withdrawn with liberty as prayed. If any such revision application is filed under section 154 of the

kvm 2/2 13-WP4732.14 Maharashtra State Co-operative Societies Act, 1960, the same can be considered by the appropriate authority in accordance with law. 4.

This court has not expressed any views on the merits of the matter as well as on the issue of limitation that may be raised if any by the respondent no.1.

If any such revision application is filed along with application for condonation of delay, the same can be considered by the Divisional Authority after considering the fact that the petitioner had pursued the writ petition in this court. No order as to costs. [R.D. DHANUKA, J.]
