P.C:- Petitioner's main grievance in this Petition was that, his application made to the Chief Commissioner of Income Tax for waiver of interest, was not disposed of. In the meantime, the department was proceeding further with the process of disposing of Petitioner's immovable properties.
Appearing in response to advance notice, learned Counsel Mr. Mohanty for the Department, placed on record a copy of a letter dated 29th January, 2019, under which, Petitioner has been communicated the decision of the competent authority to reject his request for waiver of interest. Reasons for such decisions are already cited. Under the circumstances, this Petition has become infructuous. We make it clear that, we have not gone into the correctness of the said order dated 29th January, 2019.
