It is pointed out by learned counsel for respondent No.2 that the trial is progressing and three witnesses have been examined and only seven witnesses remained to be examined. In all possibility the trial will conclude within three months.

In this view of the matter, learned counsel for the applicant seeks leave to withdraw the application with liberty to file a fresh application after three months, if the trial does not progress substantially.
