Heard. By this petition under Article 226 of the Constitution of India, the Petitioner is seeking directions against the Trial Court i.e. Bombay City Civil Court at Dindoshi to hear Short Cause Suit No.661/2015 on priority within 3 months from the date of order.
The learned counsel for the Petitioner submits that by way of said suit, the Petitioner is seeing decree of removal of Defendant from the suit premises viz. Shop No.14, Shweta Park CHS Ltd., Daulat Nagar, Road No.2, Borivali (E), Mumbai - 400066 admeasuring about 240 sq.ft. built up area of village Eksar, Tq. Borivali, Mumbai suburban District bearing CTS No.2696.

11.1161.21-wp.odt The learned counsel for the Petitioner submits that the Petitioner is not keeping well and therefore, the present Writ Petition has been filed for early hearing of the suit. Considering the submissions made by the learned counsel for the Petitioner and the averments made in the Writ Petition, we do not find any reason to expedite the hearing of Short Cause Suit No.661/2015, out of turn. Hence, the Writ Petition stands dismissed.
No order as to costs.
