This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No.128 of 2021 registered at Baramati City Police Station, Pune (Rural) for the ofences punishable under Sections 420, 409, 468 and 120(B) of the Indian Penal Code.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 4.

According to the prosecution, the work of reflling cash in ATMs was assigned to the complainant Secure Value India Ltd. Company. It is alleged that the co-accused, who were working with the said company misappropriated the amount to the tune of Rs.3,02,16,600/- while reflling the cash in ATMs. Dinesh S. Sherla 1/2

The allegations against the applicant appears to be that the alleged misappropriated amount was given to the present applicant for the purpose of investment. Prima facie, the applicant does not appears to be part of alleged conspiracy to misappropriate the amount in question.

Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicant in C.R. No. 128 of 2021 registered at Baramati City Police Station, Pune (Rural) for the ofences punishable under Sections 420, 409, 468 and 120(B) of the Indian Penal Code, the applicant be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Ofcer and shall cooperate in the investigation.
