IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.1565 OF 2014 IN FIRST APPEAL (ST) NO.6461 OF 2014 HDFC Ergo General Insurance Co Ltd ...Applicant

Versus

Bodhraj Inder Ram Sharma & Ors

...Respondents

Mr Milind Sathaye, for the Applicant.

CORAM: G.S. PATEL, J DATED:

14th July 2017 PC:- 1.

The noting shows that the Civil Application for condonation of delay has been dismissed against the Respondents Nos.1 and 2. The Appellants supplied fresh addresses for both. No notice seen has been sent by Registry despite this.

2.

The question of delay and its being condoned is really always a matter between the Applicant and the Court. It is only where the Court is not satisfied as to the genuineness of the explanation that time should be spent in serving notices. The delay is condoned. 3.

The Civil Application is disposed of. No costs. (G. S. PATEL, J.) 14th July 2017
