None has been appearing for the Petitioner and in the absence of any interim order granted to the Petitioner, the Petition has to be dismissed as having been rendered infructuous. 2.

Pleading that the Petitioner completed the III and the IV Semester in the College established by Respondent No.1 the grievance is that inspite of having taken admission in the III year and paid the necessary fee he was not permitted to appear for the V Semester. Prayer made in the Petition is to allow the Petitioner to appear for the V Semester examination.

It appears from the pleadings that the Petitioner undertook the V Semester course and also appeared in the examination.

Be that as it may, the Petition has obviously been rendered infructuous and is disposed of accordingly. N.M.JAMDAR, J.
