In crime No.160/2018 for offence punishable under sections 307, 353, 332 and 504 of the Indian Penal Code registered with Yeola police station, Nashik, the applicant is seeking pre-arrest bail.

The submissions are, after the earlier application was withdrawn, the change in circumstances is of filing of the chargesheet.

The role attributed to the applicant in the crime in question is of assaulting and threatening the public servant while discharging his official duty. The applicant under the garb of the pending application has avoided his arrest since September, 2018. In a calculated manner, the applicant has waited till the filing of the charge-sheet and is using the same to his advantage for approaching this Court.

Considering the role attributed and the attributions against the applicant, I hardly see any convincing reason which warrants release of the applicant on pre-arrest bail. The application is rejected.
