The challenge in this petition is to the order dated 16th November 2022 passed by the Family Court No.5, Mumbai in Petition No.A-766 of 2017 partly allowing the application for interim maintenance filed on behalf of the minor son. 2.

The Family Court partly allowed the application mainly on the ground that the expenses as sought by the petitioner are not supported by the documents.

Therefore, it would be in the fitness of things that the petitioner produce documents in support of the claim made by the petitioner. The Family Court shall adjudicate the application below Exhibit-13 based on the documents produced by the parties and shall arrive at decision. Till the pendency of the petition, the

40-wp4461-2023.doc respondent shall continue to pay at the rate as directed by order dated 16th November 2022.

In the facts of the case, the Family Court shall decide application below Exhibit-13 after giving opportunity to both sides to produce material in support of their case within three months from today.
