2/3 12 ABA 619-21.doc P.C:- The applicant was admitted to interim protection on 9th March 2021 by recording a statement made on behalf of the applicant to the effect that the total amount due and payable to the complainant is Rs.,9,37,600/- and the applicant submitted before the Court that he shall pay an amount of Rs.4,37,600/- within one week and balance amount of Rs.five lakhs within a period of four weeks from the date of payment of first instalment. Accepting the said statement, he came to be released on bail in the event of his arrest.

Though there was some delay in making the remaining payment, for some point of time and this prompted the Court to record the said development, on 5th January 2022, the counsel for the applicant made a statement that the entire payment due, shall be cleared before the next date. Accordingly, the learned counsel for the intervenor submits that he has received the balance consideration in terms of the order dated 9th March 2021. The said statement made on behalf of Advocate Prithviraj Gole, is accepted.

In wake of the above, the order dated 9th March 2021 is made absolute.
