Heard learned counsel for the parties.

By this petition, the petitioner has sought the following substantive relief:

(a) That this Hon'ble Court to pleased to issue writ in the nature of certiorari, or any other appropriate writ, order or direction declaring the Impugned Order dated January 24, 2022 passed by the respondent to be 1/3

arbitrary, invalid, bad in law and set aside and quash the same qua the petitioner;

Learned counsel for the Petitioner submits that during the pendency of this Petition, the petitioner made a representation with the Respondent-Pune District security Guard Board, Pune (Board) and sought hearing. He submits that the Respondent Board has given them one hearing and that the next hearing is scheduled tomorrow i.e. on 28th April 2022. 4.

In view of the said development, learned counsel for the Petitioner seeks leave to withdraw the Petition with liberty to file a fresh Petition seeking the same reliefs, if the occasion so arises. 5.

Learned counsel appearing for the Respondent Board does not dispute the fact, that post the impugned order dated 24th Jan 2022, the Petitioners have been given a hearing.

Accordingly, the Petition is disposed of as withdrawn with liberty as prayed.

In the event, an adverse order is passed by the said Board, the same shall not be given effect for the period of one week to enable the 2/3

petitioner to file appropriate proceedings.

We make it clear, that we have not gone into the merits of the Petition and at such all contentions of all parties are kept open. 9.

The petition is disposed of on the aforesaid terms. 10.
