P.C. :- 1] Heard Mr. Rohit Sonawane, learned counsel for the appellant and Mr. Sagar Bhirange, learned counsel for the respondent.

2] By order dated 2nd February 2010, Hindu Marriage Petition No. 342 of 2006 was allowed and the marriage solemenised between the parties on 23rd February 2003 was dissolved. The petitioner - husband was directed to pay permanent alimony at the rate of Rs.4000/- per month to the respondent - wife.

DSS 11-sa-802-17.doc 3] Mr. Sagar Bhirange submitted that till date, the petitioner - husband (Ramesh Dumbare) has not paid a single penny to the respondent - wife (Suvarna Dumbare) as per the order passed by learned Trial Court, which is confirmed by the Appellate Court. On the other hand, Mr. Sonawane submits that the appellant - Ramesh Dumbare has made part payment.

4] As the appellant - Ramesh Dumbare has not complied fully the order of Trial Court for payment of maintenance at the rate of Rs.4000/- per month, this Second Appeal is deferred. It is made clear that if within four weeks from today, the appellant - Ramesh Dumbare does not paid the entire arrears of maintenance as per the order dated 2nd February 2010, Second Appeal shall stand dismissed without further reference to the Court. If the payment is made or deposited in this Court, list the appeal for admission on 24th September 2019.
