1) This is an application for bail on medical ground. The learned APP has produced the medical papers of the applicant. It appears from the record that the applicant is suffering from CA Buccal Mucosa. It further appears from the record that the applicant is required to take regular medication from Tata Cancer Hospital. The Superintendent, Mumbai Central Prison by his report dated 11.4.2017 has stated that Jail Authority has primary medical facilities and it does not have facilities to take care of Tracheotomy and it is requested therein to direct the Medical Superintendent of Tata Cancer Hospital for better treatment.
2) After taking into consideration the medical record produced by the learned APP., the applicant deserves
2 /2BA-540-17-914 to be released on bail on medical ground.
3) Hence, the following order.
a) The applicant be released on bail on his furnishing PR bond of Rs.25,000/-with one or two solvent local sureties in the like amount.
b) The applicant shall not tamper with the evidence and /or influence the prosecution witnesses. c) The applicant shall attend the dates before the Trial Court whenever necessary.
d) In view of the medical condition of the applicant he is permitted to furnish cash bail of Rs.25,000/- and he shall comply with the conditions mentioned in clause(a) within a period of eight weeks after his release from the concerned Jail.
e) Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
