The main grievance in the writ petition is about the unauthorised construction raised by Respondent Nos. 6 and 7. Admittedly, the said structure is within the jurisdiction of Baramati Municipal Council - Respondent No.9 herein. In our view, the grievance of the Petitioner can be redressed by directing the Chief Officer / City Engineer of Baramati Municipal Council to treat and consider this writ petition as a representation of the Petitioner and decide the same as expeditiously as possible and at any rate within the period of four weeks from the date of receipt a copy of this order. Ordered accordingly.

The Chief Officer / City Engineer shall consider the grievance of the Petitioner made in this writ petition independently, on its own merits and in accordance with law. All points and contentions of the respective parties are kept open. The authority concerned shall give an opportunity of hearing to all concerned and pass a speaking patilsr 1 / 2

order.

In order to enable the Chief Officer / City Engineer to comply with this order, the Petitioner as well as Respondent Nos. 6 and 7 shall remain present before the authority on 16th April 2018 at 11.00 a.m. along with a copy of this order and a certified copy of the writ petition.

Writ petition stands disposed of.
