DATED : 28 MARCH 2023 P.C. :- This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 822 of 2022 registered at Khed Police Station, Pune (Rural) for the offences punishable under Sections 326, 504, 506 of the Indian Penal Code. 3.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

According to the prosecution, on the date of incident, which took place on 10 December 2022, dispute arose between the applicant and the complainant on some trivial issue. It is alleged that during the said dispute the present applicant assaulted the complainant and her husband by stick MJ Jadhav 1 / 2

26-ABA-617-23.odt due to which the husband of the complainant alleged to have sustained grievous injury.

The learned counsel for the applicant submits that pursuant to the order passed by this Court dated 28 February 2023, the applicant has deposited an amount of Rs. 25,000/- with the Investigating Officer towards medical expenses of the husband of the complainant. 6.

Prima facie, the incident does not appear to be premeditated. There are no other criminal antecedents. Considering the overall facts and circumstances, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed:

(i) Application is allowed.

(ii) In the event of arrest of applicant in Crime No. 822 of 2022 registered at Khed Police Station, Pune (Rural) for the offences punishable under Sections 326, 504, 506 of the Indian Penal Code, he shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

The Investigating Officer shall hand over the amount to the complainant.
