The Applicant is seeking regular bail in Crime No. 438 of 2018 for an offence punishable under Sections 379 read with Section 34 of the Indian Penal Code.

Though strongly opposed by the learned APP, in my opinion, the Applicant deserves to be released on regular bail, as the Applicant was subjected to custodial interrogation and the other co-accused who are similarly placed are already released on bail. Hence, the following order.

ORDER
(A) The Applicant be released on bail in Crime No. 438 of 2018 for an offence punishable under Sections 379 read with Section 34 of the Indian Penal Code on executing PR Bond of Rs.25,000/- with one or more sureties in the like amount.
(B) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
