The learned counsel for the appellant, on instructions, submits that Special Civil Suit No. 878 of 2009 has been dismissed for default on 18th February 2014.

In view of this subsequent development, the appeal as well as pending civil applications are disposed of.

Needless to state that if Special Civil Suit No. 878 of 2009 is restored, the contentions raised in the present appeal would be open for being urged.
