Heard the learned counsel for the Applicant and the learned APP for the Respondent - State.

By this application, the Applicant seeks modification of the order dated 23rd January, 2015, passed by this Court (Coram:P.D.Kode,J.) in Criminal Bail Application No.2741 of 2014, in particular, para 4 of the order, inasmuch as, it directs the release of the applicant on P.R.Bond in the sum of Rs.30,000/- with one surety to make up the like amount. The modification of the order sought reads as under ;-

........... The Applicant is directed to be released in Special Case No.81 of 2014 arising out of C.R.No.88 of 2014 registered with Samatanagar Police Station, on furnishing the P.R.Bond in the sum of Rs.30,000/- (Rupees Thirty Thousand only) with one surety to make up like amount .....

Learned Counsel for the applicant submitted that the applicant is a poor person and has not been able to furnish the P.R.Bond amount in the sum of Rs.30,000/- with one surety to make up the like amount, as directed vide order dated 23rd January, 2015. She submitted that the applicant has been languishing in jail, despite the order enlarging him on bail.

Learned APP states that she has no objection if the order is modified and if the amount is reduced.

Accordingly, for the reasons set out in the application, following order is passed : -

ORDER

(i) Resultantly, the application is allowed. The Applicant is directed to be released in Special Case No.81 of 2014

3/3 arising out of C.R.No.88 of 2014 registered with Samatanagar Police Station, on furnishing the P.R.Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand only) with one or two sureties to make up like amount instead P.R.Bond in the sum of Rs.30,000/- ;

ii) The rest of the conditions imposed vide order dated 23rd January, 2015, to remain as it is.
