Heard Mr. Pradip Thorat, learned counsel for the petitioner, Mr S.G.Deshmukh, learned counsel for respondent no.1B, and Ms Aparna Devkar, learned counsel for respondent no.4 at length. 2.

By this Petition under Article 227 of the Constitution of India, the petitioner has challenged the Judgment and order dated 14.1.2016 passed by the learned trial Judge below Exhibit313 in Spl. Civil Suit No. 25 of 1992. By that oder, the learned trial Judge rejected the application made by the petitioner, hereinafter referred to as 'plaintiff' under Order VI, Rule 17 of C.P.C. for amending the plaint.

After arguing the petition for quite some time, Mr. Thorat, upon taking instructions from instructing Advocate Mr. S.M.Sabu,

On the motion made by Mr. Thorat, Petition is allowed to be withdrawn and is dismissed as withdrawn.
