By this petition, the petitioners seeks registration of an FIR on the basis of the representation made by the petitioners i.e. representations dated 26th February 2020; 14th January 2020 and 2nd December 2019.

According to the petitioners, on the basis of the said complaints, the police ought to have registered an FIR as against one 1/3

Vikrant Gokhale and Arvind Yadav for the alleged offences punishable under Sections 420, 406, 120B r/w 34 of the Indian Penal Code and provisions of the Maharashtra Protection of Interest of Depositors Act (MPID Act).

Learned APP submits that way back in July 2020 i.e. on 27th July 2020, the petitioners were informed that the complaints/representations made by them were looked into and enquired into and that they have come to a conclusion that the dispute was of a Civil nature and accordingly the said complaints/representations were filed. The said letter dated 27th July 2020, is at Exhibit - 'K' from page Nos.37 to 42 of the aforesaid petition.

Considering the aforesaid, nothing survives for further consideration in this petition. The petition stands disposed of accordingly.

Needless to state, that it is always open for the petitioners to file appropriate proceeding, as maintainable in law, before the appropriate forum/court.

We make it clear, that we have not gone into the merits of the complaints/representations made by the petitioners as stated aforesaid and as such all contentions of all parties are kept open. 7.

All concerned to act on the authenticated copy of this order.
