This is an application under Section 438 Cr.P.C. seeking pre-arrest bail in Crime No. 184 of 2021 registered with Wada Police Station, for offences under Section 379 and 411 r/w. 34 of Indian Penal Code. 2.

Heard Mr. Pandey, learned Counsel for the Applicant and Mr. Yadav, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties .

The aforesaid crime was registered pursuant to the FIR lodged by Sandip Namdeo Dupa. The first informant has alleged that some copper coils and transformers were stolen from RMC Plant. It is alleged that the Applicant herein had received the stolen goods. By order dated 9.3.2022 this Court had observed that the stolen property was recovered at the instance of the co-accused, and hence this Court had granted pps

918 aba 620-22.doc interim bail to the Applicant, with further directions to report to the Investigating Officer. Learned Counsel for the Applicant has stated that the Applicant has reported to the Investigating Officer and he has been interrogated.

In view of the above facts and circumstances, the Application is allowed on the following terms and conditions:- (i) In the event of arrest of the Applicant in Crime No. Crime No. 184 of 2021 registered with Wada Police Station, the Applicant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twentyfive Thousand Only) with one or two solvent sureties in the like amount, to the satisfaction of the Investigation Officer. (ii) The Applicant shall report to the Investigating Officer if required. (iii) The Applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer. (iv) The Applicant shall not change his residential address without prior intimation to the Investigation Officer. (v) The Applicant shall not interfere with the complainant and the other witnesses in any manner.
