The above Writ Petition has been filed for a direction against the Respondent to take necessary steps against the accused in FIR No.332 of 2011 registered for the offences punishable under Sections 406, 420 read with 34 of the Indian Penal Code. The second relief sought is for a direction against the Respondent to submit a report in respect of the other two accused against whom till date, no report of whatsoever nature has been filed by the Respondent.
The learned APP Shri R M Pethe, appearing for the Respondent/State, informs us that a report under Section 169 of the Criminal Procedure Code has been filed against the accused Nos.3 and 4 in the concerned Court i.e. the learned Metropolitan Magistrate, 24th Court, Borivali, Mumbai.

(919) wp-1004.18.doc In view thereof, it is not necessary to keep the above Writ Petition pending. If the Petitioner intends to pursue the relief sought vide prayer clause (a), he is at liberty to make an appropriate representation to the concerned police station within two weeks from date. If any such representation is received, the Senior Inspector of Police of the concerned police station to look into the same, take a decision thereon and communicate his decision to the Petitioner within four weeks thereafter.
With the directions as aforesaid, the above Writ Petition is disposed of.
