Learned APP submitted that the police have invoked the provisions of the MCOC Act to the present crime i.e. I-20 of 2017 dated 16.01.2017 registered with Narpoli Police Station, District Thane on 11.03.2017.

In view of the said statement, learned counsel for the applicant, seeks leave to withdraw the present application with liberty to file a fresh application for bail before the Trial Court if the police submits charge-sheet under the provisions of MCOC Act. 3.

It is made clear that if the police after investigation drops charges under the MCOC Act, the applicant is at liberty to file a fresh application for bail before the Trial Court.

Leave and liberty granted.

The application is disposed of as withdrawn in the aforesaid terms.
