Mr. Killedar, the learned Counsel appearing for the Respondent No.2 having taken instructions from his officer makes a statement that Geeta Kale, the surplus teacher from Shobhatai Sopal Prima School, Barshi is already absorbed in some other school and therefore the impugned order dated 30th January 2015 directing the Petitioner to absorb said Geeta Kale will not survive. The said statement is accepted. In view of the statement, Mr. Mane, learned Counsel appearing for the Petitioner concedes that the grievance of the Petitioner at present no more survives. We, therefore dispose of the writ petition. We however make it clear that we have not gone into the grounds of challenge raised in the petition and same are expressly kept open.
