Heard learned counsel for applicants and learned APP. Perused case diary. While granting interim protection to applicants, it is observed that in this crime, there is involvement of 10-12 male accused and 3-4 female accused who have abused complainant's son and assaulted by wooden stick, iron piper and glass bottles and in the course of same transaction, female accused persons had removed valuable ornaments from persons of complainant's family members with cash of Rs.3,000/-. Admittedly, other co-accused are arrested and cash is recovered from them. Having considering role attributed to applicants in report which prima facie is found to be vague and as no specific role is attributed to applicants, their involvement in the present crime is not established.

ppn 2 5.aba-484.19.doc Moreover, while granting interim protection, applicants had marked their presence with Investigating Officer. In the circumstances, as investigation is in progress, application is liable to be allowed by imposing conditions as per order below :-

ORDER

(i) Interim order dated 19th March 2019 stands confirmed with a direction to applicants to attend Investigating Officer between 11.00 a.m. to 2.00 p.m. and thereafter as and when called till filing of charge-sheet. (ii) Application stands disposed of in above terms. P.N. DESHMUKH, J.
